1. About These Terms
These Terms and Conditions (“Terms”) govern your access to and use of the The Piggy Thai Food & Mookata online shop at thepiggy.my and your purchase of food, beverages, meal packages and related products from us.

In these Terms, “The Piggy”, “we”, “us” and “our” refer to Actually Thai Sdn Bhd. “Customer”, “you” and “your” refer to the person accessing the website or placing an order.
2. Acceptance of These Terms
By accessing our website, creating an account or placing an order, you agree to:
These Terms;
Our Privacy Policy;
Our Cancellation and Refund Policy;
Our Delivery Policy; and
Any additional terms displayed during checkout.
Do not place an order if you do not agree with these Terms.
Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded under Malaysian law.
3. Customer Eligibility
By placing an order, you confirm that:
You have legal capacity to enter into the transaction or have permission from a parent or legal guardian;
The information you provide is true, current and complete;
You are authorised to use the selected payment method;
You are purchasing for lawful purposes; and
You will comply with these Terms.
We may reject or cancel an order where we reasonably suspect fraud, misuse, unauthorised payment or unlawful activity.
4. Customer Accounts
You may be required to create a customer account to place or manage orders.
You are responsible for:
Maintaining the confidentiality of your password;
Activities carried out through your account;
Providing accurate contact and delivery information;
Updating information when it changes; and
Notifying us promptly of suspected unauthorised access.
We may suspend or close an account that is used fraudulently, unlawfully or in breach of these Terms.
5. Products and Menu Information
We take reasonable care to ensure that product names, descriptions, prices and availability are accurate.
However:
Photographs are for illustration purposes;
Presentation, colour, portion appearance and packaging may vary;
Ingredients may vary due to availability or recipe changes;
Minor substitutions may be necessary;
Products are subject to availability; and
The appearance of delivered food may differ from website photographs.
We will not make a material substitution without informing you where reasonably possible.
6. Allergies and Dietary Requirements
Our food may contain or come into contact with allergens including, without limitation:
Peanuts;
Tree nuts;
Gluten;
Wheat;
Soy;
Milk;
Eggs;
Fish;
Shellfish;
Sesame; and
Other ingredients capable of causing an allergic reaction.
Although we take reasonable care, our kitchen may handle multiple allergens and we cannot guarantee that any product is completely free from traces of an allergen.
Customers with a serious allergy must contact us before ordering. Notes entered during checkout do not guarantee that an allergy request can be accommodated.
Customers are responsible for checking that products are suitable for their dietary, religious, medical or allergy requirements.
7. Prices
All prices are displayed in Malaysian Ringgit (“RM” or “MYR”) unless stated otherwise.
Prices may include or exclude, as clearly displayed before checkout:
Delivery charges;
Service charges;
Packaging charges;
Applicable taxes; and
Other disclosed charges.
The total payable amount will be displayed before you confirm payment.
We may change prices at any time. A price change will not affect an order that has already been accepted and successfully paid, except where there is an obvious pricing or system error.
8. Placing an Order
An order is an offer by you to purchase the selected products.
Before submitting your order, you are responsible for checking:
Selected products;
Quantities;
Variations or add-ons;
Delivery or collection details;
Contact information;
Requested date or time;
Promotional codes; and
Total price.
An order is not accepted merely because payment has been attempted or an automated acknowledgement has been displayed.
Your order is accepted when we confirm acceptance through the website, email, message, order-status update or commencement of preparation.
9. Product Availability
All orders are subject to product, ingredient and operational availability.
We may reject or cancel an order where:
An item is unavailable;
The website contains an obvious pricing or product error;
The delivery address is outside our service area;
We cannot contact the customer;
Payment is unsuccessful or cannot be verified;
The order appears fraudulent;
The order cannot be safely prepared or delivered; or
Circumstances outside our reasonable control prevent fulfilment.
Where we cancel a successfully paid order, we will arrange a refund for the cancelled amount through the original payment method.
10. Payment Through Razorpay Curlec
Online payments are processed exclusively through Razorpay Curlec.
Available payment methods will be displayed through the Razorpay Curlec checkout and may include cards, FPX, online banking, e-wallets or other supported payment methods.
By submitting payment, you:
Authorise Razorpay Curlec and the relevant payment provider to process the transaction;
Confirm that you are authorised to use the payment method;
Agree to any applicable Razorpay Curlec or financial institution terms; and
Authorise the exchange of information reasonably required to authenticate, process, verify, settle, refund or dispute the payment.
Razorpay Curlec is the payment gateway and is not the seller or supplier of our products. Actually Thai Sdn Bhd remains responsible for order preparation, fulfilment, delivery, customer service and merchant-approved refunds.
We do not intentionally store full card numbers, CVV numbers, online banking passwords, PINs or one-time passwords.
Never disclose your banking password, PIN or one-time password to our staff.
11. Payment Confirmation
An order will normally be processed only after we receive confirmation that payment has been successfully authorised or captured.
Where your bank account is debited but the payment status is unsuccessful, pending or interrupted:
Do not immediately repeat the payment unless instructed;
Contact us with your order and transaction information;
We will check the payment status through Razorpay Curlec; and
Any reversal or refund will be handled according to the final transaction status and the relevant bank or payment-provider process.
Bank and payment-provider processing periods are outside our direct control.
12. Security and Fraud Checks
Orders and payments may be subject to fraud-prevention, authentication and security checks.
We may request reasonable information to verify:
Customer identity;
Payment ownership;
Order legitimacy;
Delivery details; or
A suspected duplicate or unauthorised transaction.
We may refuse, suspend or cancel a transaction where verification is not completed or where fraud is reasonably suspected.
13. Order Changes and Cancellation
You must contact us immediately if you wish to change or cancel an order.
A cancellation or change is not guaranteed.
Once an order has been accepted, ingredients allocated or food preparation commenced, the order may no longer be changed or cancelled because our products are perishable and prepared for the specific order.
Where we agree to a cancellation, any refund will be handled under our Cancellation and Refund Policy.
14. Delivery
Delivery is available only within the service areas displayed on our website or confirmed during checkout.
You are responsible for providing:
A complete and accurate delivery address;
A valid telephone number;
Building, unit, gate or access information;
Relevant delivery instructions; and
A recipient who is available to receive the order.
Delivery times are estimates and may be affected by traffic, weather, order volume, kitchen operations, rider availability, building access, road closures and other circumstances.
We will take reasonable steps to deliver within the estimated period, but we do not guarantee an exact arrival time unless expressly agreed in writing.
15. Failed Delivery
A delivery may be treated as unsuccessful where:
The address is incorrect or incomplete;
The recipient cannot be contacted;
The recipient is unavailable;
Building or security access is refused;
The customer requests delivery to an unsafe or inaccessible location; or
The customer fails to collect the order within a reasonable period.
Because food is perishable, an unsuccessful delivery caused by incorrect customer information or customer unavailability may not qualify for a refund. Additional delivery charges may apply where redelivery is possible.
This does not affect rights available where the failure was caused by us or our delivery provider.
16. Receipt and Inspection
You should inspect your order as soon as it is delivered or collected.
Contact us promptly if:
An item is missing;
You received the wrong product;
The order is materially damaged;
The packaging has been seriously compromised;
The food appears unsafe or unfit for consumption; or
There is another material issue with the order.
Keep the food, packaging, receipt and relevant photographs until the complaint has been reviewed.
17. Perishable Products
Food and beverages are perishable and may be affected by time, handling, storage and temperature.
After delivery or collection, you are responsible for:
Following storage and reheating instructions;
Refrigerating products where appropriate;
Consuming food within a safe period;
Not consuming food that has been improperly stored; and
Informing recipients of relevant allergy and storage information.
We are not responsible for deterioration caused by unreasonable delay in consumption, improper storage, unauthorised reheating or mishandling after delivery or collection.
18. Refunds
Refund eligibility is governed by our Cancellation and Refund Policy and applicable Malaysian law.
Depending on the circumstances, an approved remedy may include:
Replacement of the affected item;
Redelivery;
Store credit;
Partial refund; or
Full refund.
Refunds are normally returned to the original payment method through Razorpay Curlec.
Refund timing depends on Razorpay Curlec, the relevant bank, card network, FPX participant, e-wallet provider and other payment participants. We cannot guarantee the date on which the refunded amount will appear in your account.
19. Promotions and Discount Codes
Promotions, vouchers and discount codes may be subject to additional conditions.
Unless otherwise stated:
Promotions cannot be exchanged for cash;
Promotions cannot be combined;
Promotions are valid only during the stated period;
Minimum-spend and product restrictions may apply;
Delivery, packaging and service charges may be excluded;
One promotion may be limited to one customer, account, telephone number, address or transaction; and
Promotions may be withdrawn where misuse or fraud is suspected.
20. Customer Conduct
You must not:
Use the website unlawfully;
Attempt to access another customer’s account;
Submit false payment or delivery information;
Place fraudulent orders;
Interfere with the website or payment process;
Introduce malware or harmful code;
Attempt to bypass security controls;
Scrape or copy website content without permission;
Abuse, threaten or harass our staff or delivery personnel; or
Use our products or services in a manner that infringes another person’s rights.
21. Intellectual Property
The website and its contents, including our brand names, logos, menus, photographs, graphics, designs, text and software, are owned by or licensed to Actually Thai Sdn Bhd.
You may use the website only for personal and lawful shopping purposes.
You must not reproduce, republish, modify, distribute, sell or commercially exploit our website content without prior written permission.
22. Third-Party Services
Our website may use or link to third-party services including Razorpay Curlec and delivery, mapping, communication or social-media services.
Third-party services operate under their own terms and privacy policies. We are not responsible for third-party systems except to the extent responsibility cannot lawfully be excluded.
23. Website Availability
We do not guarantee that the website, customer account, menu or checkout will always be available without interruption.
We may temporarily suspend access for maintenance, security, updates, operational reasons or circumstances outside our control.
Where a system error affects an order or payment, we will take reasonable steps to investigate and provide an appropriate resolution.
24. Limitation of Liability
To the fullest extent permitted by law, Actually Thai Sdn Bhd will not be responsible for indirect, incidental or consequential loss arising from use of the website or purchase of our products.
Our total liability relating to a particular order will generally not exceed the amount paid for that order, except where a greater liability is required by applicable law.
Nothing in these Terms excludes or limits liability for:
Fraud;
Fraudulent misrepresentation;
Death or personal injury caused by negligence;
A breach of rights that cannot lawfully be excluded; or
Any other liability that cannot be excluded under Malaysian law.
25. Events Outside Our Control
We will not be responsible for delay or failure caused by events outside our reasonable control, including:
Severe weather;
Flood;
Fire;
Accident;
Road closure;
Traffic disruption;
Power or internet failure;
Payment-network disruption;
Government action;
Public emergency;
Labour disruption;
Supply shortage;
Delivery-platform outage; or
Other force majeure events.
We will take reasonable steps to minimise disruption and communicate material changes where practicable.
26. Changes to These Terms
We may revise these Terms to reflect changes in our website, operations, payment arrangements, services or applicable law.
The updated Terms will be published on the website with the revised effective date.
Changes will not retrospectively alter an accepted order unless required by law or agreed with the customer.
27. Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect.
28. Governing Law
These Terms are governed by the laws of Malaysia.
Any dispute will be subject to the jurisdiction of the Malaysian courts, without limiting any right the customer may have to refer a matter to an applicable consumer tribunal, regulator or dispute-resolution body.
